General conditions of contract

Art. 1) GENERAL INFORMATION ABOUT JEWMIA SERVICE

These general conditions, released on January 7th 2011, aim to establish the rules for implementation of all the services offered by Jewmia through its website www.jewmia.com. Jewmia reserves the right to change them at any time. The conditions, therefore, will be those established and stated at the time of the order placed by the client.

Jewmia, a holder of the PS, legally registered with the Chamber of Commerce of Palermo with VAT 05833760829, economic administrative directory number 281641, located in Via Croce Rossa 113 / C 90144 Palermo, offers a jewelry rental service through the website www.jewmia.com to all those who, meeting the requirements stipulated by the general conditions of contract and complying with those conditions, wish to take advantage of the contractual offers in it.
The rental services offered on the site www.jewmia.com are offered to all persons of legal age who have a personal bank account, a credit card (not prepaid), a permanent address, photo identification and a valid e-mail address or fax number.

Art. 2) COVERED

This covered covers all valuable assets that at the time of order by the customer are on display on the site www.jewmia.com .

Art. 3) FORMATION OF CONTRACT

Every person who places an order on the site www.jewmia.com adheres completely and unconditionally to these terms and conditions. By clicking "I accept", the Customer remains bound by the terms and conditions, which must be read, therefore, with due care and diligence.

Every transaction between Jewmia and the customer will be considered concluded with the express acceptance by Jewmia sent by e-mail confirmation to the customer who will in turn send by fax or e-mail the receipt of the message confirmation sent by Jewmia.
Jewmia reserves the right to reject any subscription order when it considers that the requirements necessary have not been met.
Every order made by the customer , accepted by Jewmia and confirmed by the customer’s acceptance, is considered irrevocable.

However, no later than one (1) hour after having completed the contract, the customer may via fax or e-mail cancel the hire without being charged any costs or penalties.

Art. 4) RENTAL

4.1) JEWELRY RENTAL SERVICE

All items for hire activities are the property of Jewmia’s respective suppliers which Jewmia uses by "exclusive authority to hire” and are all guaranteed as regards the authenticity of materials and name brands. Upon return of items hired from Jewmia, Jewmia will closely examine its condition and lease it again only if it is in excellent condition.
Jewmia reserves the right to add or delete items from its catalog whenever it deems appropriate.

4.2) RENTAL FORMULA
The customer can hire an item of jewelry for 1 day (24 hours) or for the entire weekend (from 48h to 72h). The item will be delivered one business day prior for rentals commencing on Tuesday, Wednesday, Thursday or Friday and will be delivered the previous Friday if the rental begins on Saturday, Sunday or Monday. The return delivery is scheduled for the following business day (in the case of rentals that begin on Friday, Saturday or Sunday delivery is scheduled for the following Monday). Financial responsibility begins when the item is received (when the delivery note is signed) and ends when it is returned (when the carrier takes it back). For longer periods, an agreement must be made with Jewmia regarding terms and payments.

The customer may not request to extend the rental.

4.3) THE RENTAL RATES

The current fees for each rental formula and for each item of jewelry are available on the www.jewmia.com website.
Jewmia reserves the right to change the prices at any time. This change will apply to every rental subsequent to the date of change.
The rental payment will be by credit card and will be divided in two parts.

Part 1:: At the time of the rental, coinciding with the confirmation order by the customer, a block will be placed on the customer's credit card for an amount equivalent to the sum of a) the rental rate for the period chosen plus b) security of 25% of the market value of the item made for hire plus c) shipping costs. (Regarding to the values of a), b) and c), the customer will always have a clear understanding during the rental process and in any case before confirming the order)

Part 2: The second part, which coincides with the return of the rental item from the customer, Jewmia will authorize the release of the deposit of 25% of the market value of the property rented and simultaneously will charge the rental fees for the chosen period plus the shipping charges.

The authorization for the release of the amount of the deposit will be made by Jewmia only upon the receipt of the item in the same condition as when it was put up for hire. Damage, loss, misplacement, failure to return or absence of the good discovered after signing the delivery note will impinge upon the security deposit in part or entirely, and Jewmia reserves the right, in the case of petty theft, reckless custody, loss or irreparable damage, to charge the customer's credit card the equivalent of the difference between the market value of the object and the deposit of 25%, apart from the same security deposits, plus the amount of rental rates and shipping costs. The client pledges not to interfere with this process in any way.

Following the return of the item Jewmia will issue an invoice for the amounts owed by the customer to Jewmia that will be sent in hardcopy to the address issued by the customer during registration.

4.4) REGISTRATION OF ORDERS

At each customer order, Jewmia will send an e-mail confirmation containing the reference information of the order which the customer must confirm through an e-mail response or fax. The customer may not submit more than one hire order at a time. Jewmia will not accept additional orders until the previous order has been completed and the item/s leased have been returned.

4.5) DELIVERY

The transport will be provided by TNT or UPS, and the item leased will be delivered to the address provided by the customer when ordering. For rentals that begin on Tuesday, Wednesday, Thursdayor Friday, the jewelry will be delivered one business day prior. For rentals commencing on a Saturday, Sunday or Monday, the item will be delivered the previous Friday. The customer must carefully check the integrity of the package, the serial number of the tamper-proof envelope, and the absence of any adhesive material. The signature on the delivery note will relieve Jewmia and the carrier from any responsibility. The customer must therefore check very carefully the integrity of the numbered tamper-proof envelope that contains the item delivered by Jewmia. The carrier will be responsible to deliver the package to the address indicated in the order, and Jewmia disclaims any liability in case of dispute by the customer for acceptance of the parcel by a third party (porters, cleaners and third parties in general, even family members, of whom Jewmia did not receive any ID during the registration to the website). The order processing will be carried out within a maximum of 03 days from the subscription order confirmation e-mail issued by Jewmia.

The package will include:

  • the items with their case.
  • a tamper-proof envelope.
If the customer should verify that the actual condition of the property does not correspond to the information provided by Jewmia, he must send an e-mail notice to info@jewmia.com  or send a fax at the number listed on the site and immediately return the goods in order to obtain reimbursement.

4.6) CALCULATION OF THE DURATION OF THE RENTAL

The rental starts at 00.00 hours on the day following the receipt of the item. Legal and financial responsibility of the property extends over the entire period of actual detention of the item: it begins when you receive the item and ends when you return it.

4.7) RETURN OF PROPERTY

The customer returns the item at the end of the rental period provided. The customer will receive information from Jewmia via e-mail or fax regarding the carrier for pick-up of the goods. One of the carriers, TNT or UPS, or Jewmia will send an e-mail to the customer with the electronic document that will show the details of the collection of goods, and that the customer will printed and will give to the carrier. The customer pledges to make himself available for the collection of the parcel by the carrier, on the day and at the time indicated by Jewmia and TNT or UPS.

The customer must use the same packaging with which the item has been received (should the latter be compromised Jewmia must be informed by fax or e-mail address at info@jewmia.com), he must carefully seal the packaging and place it in the self sealing envelope provided by Jewmia. In case of difficulties in the procedures for returning the goods, the customer must contact Jewmia to agree on a return procedure.

For rentals starting on Friday, Saturday or Sunday, the goods must be returned the following Monday; for rentals that start on other days the goods must be returned the following working day.

4.8) FAILURE TO RETURN WITHIN THE TERMS PROVIDED

The return of a rented item must be made within the deadline. If the period of hire coincides with a non-working day, the return will be the next working day.
Otherwise the customer will be charged the price of a rental day for each day of delay until the date of actual recovery of the property.

Failure to return on-time will automatically extend the period of detention of the deposit on the credit card until the customer returns the property.

4.9) USE OF THE GOODS DURING THE RENTAL

The customer agrees to use the property carefully and to take all necessary precautions to prevent damage. Throughout the time that the customer has the items in his possession (from receipt to delivery), he assumes all legal and financial responsibility of the property rented.

4.10) FAILURE TO RETURN THE GOODS OR DAMAGED
In case of loss, theft, damage or absence of the good discovered after signing the delivery note the client agrees to immediately notify jewmia by e-mail or fax (with a fully detailed report of what happened), and call immediately the Authority.
In case of serious damage, the customer will still proceed with the immediate restitution of the property.
Jewmia will assume the responsibility to arrange for repairs and related expenses will be charged to the customer. All information concerning the repair costs will be provided to the customer via e-mail or postal mail at the address specified by the customer at time of rental. If repair is not possible or is deemed to be inappropriate or economically inopportune , or in case of failure to return the asset, Jewmia will charge the full value of the asset at the time of rent. Jewmia therefore will not authorize the release of the security deposit on the customer's credit card and will add the difference in charges to cover the entire value of the property. In the case of a repair, the cost charged to the customer will be deducted from the deposit which has been held since the time of rental.
The customer, in case of serious damage, loss, sleight of hand or absence of the good discovered after the customer signing the delivery note, accepts unconditionally that Jewmia will charge his credit card the full amount of the market value of jewelry made for hire, which will be done by adding the difference between the amount of the deposit (which will no longer be unlocked) and the sale value of the property to what is already blocked on the credit card. The client will not in any way endeavour to prevent this procedure.
Jewmia ensures that all goods offered are originals and also marked with stamped trademarks. The customer agrees not to replace the original with a counterfeit .
All goods returned which are found not to be those hired will be considered by Jewmia as appropriated by the customer, and Jewmia will take action against the customer by charging the full value of the item leased to the credit card customer. If the items are found to be counterfeit, Jewmia will contact the competent judicial authorities.

PRICES

All prices are in Euros and include VAT and do not include the cost of delivery.
Jewmia reserves the right to change prices at any time. All changes will be related to new orders and not to those in progress.

Art. 5) ORDINARY PROVISIONS

5.1) RULES OF PAYMENT

Unless otherwise identified in the order or in these general conditions, payment shall be made exclusively with bank credit card through a secured bank server. No customer banking information will be communicated to Jewmia nor will it pass through the www. jewmia.com website. Upon confirmation of the order the customer will be automatically directed to the bank's secure payment site which integrates the security standards SSL. Confidential information will be transmitted in encrypted form to RBS. If the total authorization, for any reason, should not be granted, the customer cannot rent the item and Jewmia reserves the right to refuse any orders without providing any justification, unless specifically requested. Any amount due and not paid on time can lead to higher interest rates than the legal rate beginning from the rental date until the completion date without notification.

5.2) COMBATTING FRAUD BANK (FIA-NET)

5.3) RULES TO ENTER AND LATE DELIVERY
Deliveries are made throughout the E.U.
The item will be delivered to the address provided during the subscription registration. Transportation and delivery will be made by TNT or UPS.
In the event of late delivery of the item not exceeding 02 days working (in addition to the 03 days foreseen for delivery) from the order confirmation sent by Jewmia, the customer is not entitled to any compensation beyond that period, pending verification, Jewmia will authorize the release of the full amount blocked on the customer's credit card. The customer has the duty to examine the product upon delivery and report any problem immediately via fax or email.
If the packaging has been tampered with, the customer has the right to refuse the package, noting the reason on the bill of lading in the presence of the courier and the customer must advise Jewmia by e-mail or fax. Therefore, the signature on the delivery note relieves the carrier and Jewmia from any responsibility.
In order to safeguard its interests and provide the customer with a stronger assurance, Jewmia records a film (for every dispatched order) that proves the placement of the good inside the package and the tamper-proof envelope, and reserves the right to show a copy of the film to the designed authority whenever necessary. The tamper-proof envelopes are unique, non reproductible and numbered.
The carrier is required to collect only packages wrapped in tamper proof sealed envelopes, so it is up to each client to deliver them to UPS or TNT in the tamper proof sealed envelope provided by Jewmia, and it is his responsibility if, once the package is back at Jewmia, the goods are damaged, broken or missing.

5.4) PERSONAL INFORMATION

The customer agrees to provide Jewmia with accurate data and to report any change of the data especially in case of change of address and change of bank details. The customer pledges preserve the confidentiality of the identity and access codes, as they are strictly personal.

5.5) PRIVACY

The personal data collected through the registration and hiring procedures will be treated in compliance with Legislative Decree 196/03 on the right to privacy. These data will never be used for other purposes, or transferred to third parties for any reasons such as business, legal, financial, etc.. Exceptions are made for legal obligations for administrative and accounting procedures. The data will, however, be communicated to the carrier for the delivery order and / or communications relating to orders placed.

5.6) COPYRIGHT

All content on the site Jewmia.com, such as text, graphics, logos, images and photos are owned by Jewmia or its affiliates or content suppliers and are protected by Italian law, and by the EU 's law on international copyright and database rights. The compilation of all content on the site is the exclusive property of Jewmia and is protected by Italian law and the EU 's law on international copyright and database rights.
You may not reproduce, extract and / or use parts of the site content, nor create or publish your own database which shows substantial parts of the site (such as pricing and product listings) without the written permission of Jewmia. The trademarks featured on this website are registered by the companies to which they belong.

5.7) RESPONSIBILITIES

The photographs illustrating the property are offered as reference only. Any variation due to normal use of that asset should not be considered a defect of the item. Jewmia is not liable for breach of contract with the client due to situations which are unpredictable and beyond their control.

5.8) CONDITIONS AND JURISDICTION

In accordance with EC Regulation of 17 June 2008 No. 593 (Rome 1 Regulation, in force since 17/12/2009) the parties agree that any contract between Jewmia and its customers is concluded in Italy and is entirely subject to Italian law regulations, which govern the completion, execution and termination, and under which it will be interpreted, even to the resolution of disputes arising from it. The language of this contract is the Italian language. For any dispute arising from the implementation of this contract, the parties undertake to submit the dispute to a mediation hearing with the Chamber of Commerce of Palermo and to consider the Court of Palermo as the authority.
